Ang " presumption of innocence " ba ay applicable sa impeachment cases?
May pagtatalo sa mga abogado at mga politiko na ang impeachment ay hindi isang criminal case kaya naman hindi dapat maging sobrang " teknikal" o " mahigpit" sa pag presenta ng ebidensya at lalo na sa pagtanggap ng ebidensya.

May pagtatalo sa mga abogado at mga politiko na ang impeachment ay hindi isang criminal case kaya naman hindi dapat maging sobrang " teknikal" o " mahigpit" sa pag presenta ng ebidensya at lalo na sa pagtanggap ng ebidensya.
Una ay ang basic rights ng akusado sa criminal case o respondent sa impeachment case na PRESUMED INNOCENT.
Presumed innocent rin ba si VP SARA sa impeachment trial? Opo. Tulad sa criminal case, the burden of proof rests entirely on the prosecution. Kaya nga ang mga prosecutors ang unang naglalatag ng ebidensya. Kailangan patunayan nila ang mga allegations sa Articles of Impeachment na sinampa ng House of Representatives sa Senado.
May " right to remain silent ba" na karapatan si VP SARA sa impeachment trial tulad ng akusado sa criminal case? Opo.
Kaya hindi totoo ang mga paratang ng ilang congressman na ang hindi pag attend ni VP Sara sa trial ay pag amin ng kasalanan. Hindi siya required to be personally present or take the witness stand.
Pero anong kailangan na ebidensya para ma convict si VP Sara? Assuming na titimbangin ng mga senator judges ang ebidensiya at isasantabi ang political bias ng bawat isa.
Sa criminal case dapat ay PROOF BEYOND REASONABLE DOUBT. Dahil sa criminal case pag convicted ay may hatol ng kulong dapat ay PROOF BEYOND REASONABLE DOUBT.
Pero ganoon din ba sa impeachment? Ang kailangan ang ebidensya ay CLEAR, CREDIBLE and CONVINCING that the acts alleged are IMPEACHABLE OFFENSES.
So far, ang mga ebidensya ba na priniprisinta ng prosecution tulad ng mga NBI witnesses ay CLEAR, CREDIBLE AND CONVINCING to prove the impeachable offense na" there is culpable violation of the constitution, high crimes, and betrayal of public trust?"
Ang video ba ni VP SARA ay CLEAR, CREDIBLE and CONVINCING na there is culpable violation of the constitution, high crimes, o betrayal of the public trust?
Sapat na ba ang mga testimonya ng mga kawani ng NBI para patalsikin ang bise presidente sa puesto at i disqualify siya to hold public office perpetually?
Kung hindi si VP Sara ang respondent, at halimbawa ang presidente ang nasa video at ang kanyang sinabi ay pag namatay ako ay may assasin na akong kinausap para patayin si VP SARA at pamilya niya ay sampahan kaya ng mga congressmen ang presidente ng impeachment?
The impeachment court is a political court that enforces constitutional accountability. Hindi criminal court para ipakulong si VP Sara. At hindi armas para durugin ang kalaban sa politika.
