Desisyon ng Korte Suprema : PAGCOR AT PCSO ibigay ang dapat sa PSC

Habang marami ang mga negosyante at politiko ang nagbigay ng pabuya sa mga olympians natin, hIgit na mahalaga ang naging hatol ng Korte Suprema sa kasong JOSELLER M. GUIAO VS PAGCOR, PSO et al (G.R. no. 223845, May 28 2024).

Si Guiao ay mas kilala bilang coach sa mga sports fans.

Ito na marahil ang pinakamahalagang panalo niya sa kanyang legendary career. BILLIONS OF PESOS PARA SA ATING ATLETANG PILIPINO! Noong 2016 ay nagsampa ng kaso si Cong. Josseler" Yeng" Guiao laban sa PAGCOR at PCSO na iremit ng mga ito sa PSC ang parte ng PCSO draws at PAGCOR income na ayon sa RA 6847 o ang Pilippines Sports Commission Act.

Ayon sa Korte Suprema, kung saan ang ponente ay si Justice Marvic Leonen- "The Philippine Amusement and Gaming Corporation is ordered to account and remit the full amount of 5 per cent of its gross income per annum after deduction of its 5 percent franchise tax, from 1993 to present in favor of the Philippine Sports Commission. "

" Philippine Charity Sweepstakes Office is ordered to account and remit to the Philippine Sports Commission the 30 per cent representing the charity fund of the proceeds of six Sweepstakes or lottery draws per annum, for the years 2006 to present."

Sa demandang mandamus ni Cong. (coach) Guiao ,matagal nang nilalabag ng PCSO at PAGCOR ang nakasaad sa section 26 ng RA 6847.Pinalagan ito ng PAGCOR at sinabi na PSC is not entitled to the full five percent since subject pa sa deductions ito. Sabi naman ng PCSO, ang PSC ay sa sweepstakes draws lang at hindi sa lotto may makukuha.

Pero hindi ito kinatigan ng Korte Suprema at sinabing " the Sports Commission has been naglected for decades." Sabi ng Korte Suprema- "Without the necessary funding for the Commission, one cannot expect it to efficiently fulfill its functions. Moreover with insufficient funds, the entire existence of the Commission is made futile and its role in sports development and nation building is rendered nugatory.

Ang kapasyahan ito ng Korte Suprema ay magbibigay ng bilyon-bilyong piso sa PSC sa habang panahon na mapapakinabangan ng mga atletang Pilipino.

Mabuhay ang Korte Suprema ng Pilipinas. Maraming maraming salamat sa mga Supreme Court Justices. All of you are " noble sportmen in robes" that our sports loving countrymen will forever be grateful and proud..MISMO!
